The import and export of narcotics is subject to strict regulations and can present many companies with insurmountable hurdles. This is because, even within the European Union, according to § 11 (1) of the Narcotics Act, every import or export requires an import or export license from the BfArM - and this applies to every single shipment.
The issuance of import and export licenses also requires a permit pursuant to § 3 of the German Narcotics Act (BtMG) and is regulated in the German Narcotics Foreign Trade Ordinance (BtMAHV). In this context, the requirements for the transport of narcotics vary from country to country.
If you wish to import narcotics from non-EU countries, you must comply with additional regulations to protect consumers in accordance with the Medicines Act. Mandatory requirements are:
- a competent person,
- suitable storage facilities and laboratories,
- a GMP certificate
- a customs certificate (§ 73 para 6 AMG)
- Import permit according to § 72 para 1 AMG
